What is actually a Child Arrangement Order?
A Child Arrangement Order is a legal document issued by the family court in the UK. It outlines the specifics of:
Where a child will live (Residence Order)
Who the child will spend time with and when (Contact Order)
Any other arrangements for the child's upbringing
The aim of a CAO is to ensure that the child's best interests are met, promoting their welfare and stability.
When Might You Need a Child Arrangement Order?
Parents or guardians may seek a CAO when:
They cannot agree on child custody and visitation schedules.
There are concerns about a child's safety or well-being.
One parent is preventing the other from having contact with the child.
The Process of Obtaining a Child Arrangement Order
Mediation: Before applying to court, you are usually required to attend a Mediation Information and Assessment Meeting (MIAM) to explore whether mediation could resolve the dispute. There are some exception to this, for example Domestic Violence.Â
Application: If mediation is unsuccessful, you can apply to the court using form C100. In cases where there are concerns about harm or abuse, form C1A is also necessary.
Court Proceedings: The court will consider various factors, such as the child's wishes and feelings (depending on their age and understanding), physical, emotional, and educational needs, and the potential impact of any changes in their circumstances.
Final Order: After hearings and possibly a report from the Children and Family Court Advisory and Support Service (Cafcass), the court will issue a final order detailing the arrangements.
